Workplace Retaliation and REDA

working man In North Carolina, you have the freedom to work without certain types of retaliation and harassment.  This protection is provided by the North Carolina Retaliatory Employment Discrimination Act (REDA).  REDA enforcement power is held by the North Carolina Department of Labor.  Generally speaking, it is illegal for an employer to fire you or otherwise negatively affect your employment because you:

  • file or threaten to file a workers' compensation claim or otherwise exercise your rights under the North Carolina Workers' Compensation Act;

  • file or threaten to file an unpaid wage claim or otherwise exercise your rights under the Wage and Hour Act;

  • file or threaten to file a workplace safety complaint or participate in an OSHA investigation or proceeding;

  • take time off from work to file for a domestic violence protective order (a/k/a "50B order");

  • otherwise engage in certain legally protected activities as shown here.

warehouse You may be entitled to lost wages, benefits, return to your former job, and possibly even the recovery of attorneys' fees.  If you believe you have been or are being retaliated against, you need to contact the North Carolina Department of Labor but first contact Attorney John O'Neal of the O'Neal Law Office to discuss your situation.
