What You Need to Have

Please obtain originals or copies of the following items as many as possible prior to our first conversation about your situation. It is understood that you may not have or be able to obtain all of the items listed, but the more of them you have, the more time it may save us in discussing and assessing your potential claim(s). Note that your failure to provide the below listed items may affect Attorney John O’Neal’s ability to assess your case.

Failure To Disclose Vehicle Damage

Additionally, contact your automobile insurance agent and ask him/her to check your vehicle’s identification number (VIN) in the claims database regarding amounts paid for property damage repairs and/or total loss payouts. Provide the O'Neal Law Office with any information you may obtain from your automobile insurance company.

Odometer Fraud, Mileage Discrepancy, Odometer Rollback

Spot Delivery a/k/a Yo-yo sale a/k/a Conditional Delivery

  • Bill of Sale, aka Buyer’s Order
  • Retail installment sales contract aka finance contract
  • Agreement to Furnish Insurance
  • All proof of payment of vehicle insurance premiums
  • Any insurance Declarations Page listed the vehicle insured by you after the purchase transaction
  • Temporary marker receipt, aka 30-day tag receipt
  • Copy of any conditional delivery agreement or other documentation referenced by dealer in asserting a conditional delivery has occurred
  • All other documents you received from seller at the time of purchase

Wrongful Repossession

  • All purchase documents including Bill of Sale a/k/a Buyer’s Order a/k/a Purchase Agreement, retail installment sales contract a/k/a finance contract
  • Receipts or proof of all vehicle payments made by you
  • Security agreement (typically gives seller and/or lender the right to repossess vehicle if breach of contract occurs)
  • All certificates of repossession
  • Correspondence or notices from seller or lender regarding potential deficiencies, payment problems, or breach of contract by you
  • Documentation of seller or lender’s usage of a GPS tracking and/or shutdown device on the vehicle

Vehicle Repairs

  • All repair estimates from the repair shop that had/has your vehicle
  • Receipts or proof of all payments made by you for repairs
  • All repair invoices and final bills
  • All correspondence (faxes, texts, letters, etc.) between you and the repair shop
  • All audio and video recordings of your conversations with employees or agents of the repair shop
  • All repair estimates and invoices from other repair shops that have inspected and/or worked on the vehicle for the issues to be handled by the original repair shop

Personal Injury

  • Accident report/crash report or exchange of information sheet
  • Copy of any automobile insurance policies covering you or your vehicle
  • Copy of your health insurance card, Medicare card, Medicaid card, etc.
  • All medical bills, records, receipts or other documentation you have related to your treatment
  • Names and contact information of all medical and health care providers you have seen and are currently scheduled to see
  • All letters or correspondence received from any insurance company (auto, health, life, etc.) related to the accident/incident
  • Pictures of your injuries
  • Pictures of the damage to your vehicle or any of the vehicles involved in the incident
  • Pictures of the scene of the accident/incident
  • Names and contact information for witnesses to the accident/incident
  • If you have lost wages due to your injury, provide 3-4 pay stubs for the period immediately before the accident/incident AND at least 2 pay stubs for the periods after your return to work (if you have returned to work)

Unfair, Harassing, Illegal Debt Collection

  • Name of the creditor or collector who has contacted you, as well as the nature of the account(s) and account number(s) on which collection is being sought
  • Copy of the loan agreement, cardholder agreement, and all other documents relating to the account/contract that is being collected upon
  • Copy of all letters, emails, faxes and other correspondence you have received from the creditor and/or any persons seeking to collect on the debt
  • Copy of all letters, emails, faxes and other correspondence you have sent to the creditor and/or any persons seeking to collect on the debt
  • Statements, account histories and other documentation you have regarding the account on which collection is being sought
  • Copies of all checks, money orders or other proof of your payments made on the account
  • Copy of your credit report from any of the three major credit reporting agencies (for a free copy, visit www.annualcreditreport.com)
  • Copy of all repayment agreements, settlement agreements, forgiveness letters and other documentation of modifications made to your debt or debt repayment
  • IF YOU HAVE BEEN SUED: Copy of all complaints, summonses, motions, notices, affidavits, judgments and other court documents you have received in your case
  • Recordings or records of any harassing phone calls and other threatening communications you have received
